General Terms and Conditions of Sale (GTC)
1. Object and Application
These General Terms and Conditions of Sale (hereinafter “GTC“) define the terms and conditions under which any person (hereinafter “the User“) orders the services sold by the company Learn French and Travel With Lily – Lynda Ait Djoudi Oufella (hereinafter “LFTwL“), within the framework of a remote sales system via the Internet and mobile, for language training services defined in the shop of the Internet and mobile sites learnfrenchwithlily.fr (hereinafter “The Site“).
These GTC are brought to the attention of the Client to enable them to book a service. The fact that the User completes a service reservation request on the Site and confirms their reservation constitutes full and complete acceptance of these GTC, which shall be the sole terms applicable to the subsequent contract.
LFTwL reserves the right to modify these GTC, in whole or in part, and at any time.
2. Products
The services offered to the User are those listed in the shop published on the Site, subject to the availability of the trainer and definitive validation by LFTwL.
3. Reservation
3.1 Purchase Process
To reserve a “Solo” or “Duo” service, the User must select this service from the Site and will be redirected to the online booking platform Calendly, which LFTwL uses as a booking provider.
Scheduling:
- The User must select the desired time slot (month, day, and hour).
- There is an incompressible delay of 48 hours between the moment of reservation and the first selectable slot.
- Slots are opened two months in advance.
Information Required:
Once the slot is selected, the User must then truthfully and accurately complete the requested information in the form:
- First name:
- Last name:
- Email:
The User also has the opportunity to share information they deem useful with LFTwL in a free text field.
Payment:
If the selected service is paid, the User must also enter their bank details to proceed with payment, directly on the Calendly platform, via the payment provider Stripe. Payment is due upon order and definitively acquired by LFTwL once the service has been performed.
Confirmation:
Once all the information has been entered and payment has been made, the User receives a confirmation email containing:
- A videoconference link (Zoom) with their connection code.
- A calendar invitation.
- An invoice related to the payment made (if applicable).
3.2 Specificities of the “Solo”, “Duo” 10-hour Packages and coaching programs.
To reserve a 10-hour package, “solo” o “duo” or a coaching program, the User follows the same procedure as above, but only the first hour is reservable this way.
Booking Remaining Hours: For the remaining service hours, the User must contact LFTwL by email at contact@learnfrenchwithlily.fr or by phone to schedule other slots until the balance of their package is exhausted.
Validity: Packages and coaching programs have a validity period of 6 months from the date of purchase (date of reservation of the first hour). After this period, unreserved hours will be lost, and the User will not be entitled to any refund, except in cases of force majeure or fault attributable to LFTwL. A commenced service package will not be refunded, whether in full or in part.
3.3 Specificities of the “Duo” Package
For “Duo” lessons, the reservation is made by a single person (the User), who remains the sole point of contact for LFTwL.
- The User undertakes to pay for the entire service and is the sole recipient of the confirmation email (containing the videoconference link and calendar invitation).
- It is the User’s responsibility to inform their partner (“binôme”) and ensure they are available and informed of the connection procedures.
- LFTwL cannot be held responsible for any difficulty encountered by the partner resulting from the User’s failure to transmit the necessary information.
3.4 Specifics of Mini-Group Conversation Workshops
Conversation Workshops are collective sessions bringing together a minimum of 3 and a maximum of 6 participants, organized by language level.
Booking Process: The User completes their booking according to the procedure defined in Article 3.1. Unlike the “Solo” or “Duo” services, the dates and times for the Workshops are fixed and set by LFTwL. The User registers for a specific time slot that cannot be modified or rescheduled.
Service Maintenance Condition (Quorum): The holding of the Workshop is strictly subject to the registration of a minimum of 3 participants. If this quorum is not met at the latest 24 hours before the scheduled time, LFTwL reserves the right to cancel the session. In this sole hypothesis, the User will be fully refunded for the amounts paid for said session via the credit card used for payment.
Cancellation and Non-Refund Policy: All bookings for a Conversation Workshop are final and binding. In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure service provisions provided on a specific date or during a specific period. Consequently, no refund, credit, or rescheduling will be granted in the event of absence or cancellation by the User, regardless of the reason.
Access to Service: The User receives a Zoom videoconference link after payment validation. It is the User’s responsibility to verify their availability and technical connection prior to booking, as the seat is reserved nominatively and the session will be maintained for the rest of the group despite their potential absence.
3.5 Behavior and Commitment
The User agrees to demonstrate diligence and punctuality to ensure the smooth running of the sessions. LFTwL reserves the right to interrupt the service or terminate a package (including 10-hour packages) early and permanently, without any refund (even partial), in the following cases:
Repeated Lateness: Systematic delays by the User that impact the duration of the session or the overall organization of LFTwL.
Recurring Absences: Failure to attend sessions (“no-shows”) without respecting the 48-hour notice period.
Abusive or Repeated Cancellations: Frequent cancellations or rescheduling, even when the 48-hour notice is respected, if such actions disrupt the organization of LFTwL’s schedule or the User’s pedagogical progress.
Booking Misconduct: Blocking time slots on Calendly without final validation or systematically failing to respect the proposed time slots.
Lack of Communication: Failure of the User to respond to LFTwL’s contact attempts to schedule sessions for a package that has already commenced.
3.6 General Provisions
The free service may only be used once per User. Any attempt to circumvent this rule—including, but not limited to, the use of fake accounts to secure multiple free bookings—may lead LFTwL to deny access to the User.
By clicking the icon on the Site to validate a booking, the User acknowledges they have full legal capacity to enter into a binding agreement. Prior to payment, the User declares they have read and accepted these General Terms and Conditions (GTC). Consequently, the validation of the booking constitutes unreserved acceptance of these GTC.
Subject to the specific provisions for the “12-week Program” defined in Article 3.7, any cancellation request must be submitted via email to contact@learnfrenchwithlily.fr or by telephone at least 48 hours before the scheduled time. If these conditions are met, the User’s account will be re-credited where applicable, and they will be invited to select a new time slot on the Site (via Calendly for “Solo” offers and directly via email for “Duo” offers). The User may also request a full refund under these same conditions. Any refund due will be processed within a maximum of 14 days from the notification of the request, using the same payment method as the one used for the initial order.
If the 48-hour notice period has passed, a User wishing to cancel must still notify LFTwL via email; however, they will not be entitled to a refund or a replacement booking, except in cases of force majeure or a fault attributable to LFTwL.
Any delay exceeding 15 minutes past the scheduled booking time will be considered a “no-show.” This will result in the cancellation of the service without any right to a refund.
LFTwL reserves the right to refuse a booking in the event of a User’s failure to fulfill any of their obligations, and more generally, to refuse any booking that appears abnormal or incomplete for any reason. The order is only considered final once confirmed by LFTwL via email. No refund is possible once the service has been performed, except in cases of force majeure or a fault attributable to LFTwL.
3.7 Specific Provisions: “Solo 12-Week” Coaching Program
The 12-week Coaching Program is a long-term commitment service that deviates from the general refund conditions defined in Article 3.6:
Commitment and Non-Refundability: This program is based on a dedicated partnership. Once payment has been made, the order is firm and final. No refund, whether full or partial, will be granted.
Credit for Deferral (6 months): In the event of a major impossibility to begin the program on the initially scheduled date, the User may request to convert their payment into a credit valid for six (6) months. To activate this credit, the User must notify LFTwL in writing at least seven (7) calendar days before the date of the first session.
Flexibility and Rescheduling: The User may reschedule an individual session provided they give at least 48 hours’ notice. To ensure pedagogical progress and respect the instructor’s schedule, such rescheduling is limited to a maximum of three (3) instances per 12-week program.
Forfeited Sessions: Any session canceled or rescheduled with less than 48 hours’ notice, or exceeding the quota of three (3) rescheduling instances, will be considered due and will not be eligible for a make-up session or credit.
4. Price
The prices indicated are in Euros, all taxes included (TTC). Prices cannot be modified once the reservation is confirmed.
5. Means of Payment
Payment is made by credit card (CB, VISA, MASTERCARD) online via the secure payment system of the provider Stripe. The reservation must be paid in full to be registered.
6. Right of Withdrawal
No Right of Withdrawal for Fully Executed Services:
The right of withdrawal does not apply to services fully performed before the end of the 14-day withdrawal period, or whose execution has begun with the User’s express agreement. An unjustified absence by the User is not considered non-execution attributable to LFTwL.
- Example: For a service reserved less than 14 days before its execution, the User cannot use the right of withdrawal to cancel or request a refund.
Other Reservations:
For other reservations, the User has a period of fourteen (14) days from the reservation to exercise their right of withdrawal with LFTwL, without having to give any reason, for the purpose of exchange, refund, or credit note. The right can be exercised on plain paper or via email to $\underline{contact@learnfrenchwithlily.fr}$.
7. Availability of Services
Services are offered subject to the availability of the trainer. LFTwL reserves the right, at any time:
- To cancel, suspend, or postpone a reservation.
- To interrupt the execution of a service in case of misconduct by a User.
In case of cancellation by LFTwL, a new replacement slot will be offered, without this automatically giving a right to a refund.
8. Service Execution and Liability
User’s Responsibility:
- It is the User’s responsibility to note the reserved slot(s) and the associated Zoom connection codes.
- The User receives a reminder email from Calendly 24 hours before the service.
- The User must ensure they have a sufficient internet connection and adequate computer equipment. LFTwL disclaims all responsibility in case of technical difficulties or bandwidth issues.
LFTwL’s Liability:
LFTwL is held to an obligation of means. Liability is limited to direct and material damages resulting from the execution of the services, up to the total price of the services performed by the User in the last calendar year, except in cases of gross negligence or wilful misconduct.
9. Complaints
The User may submit complaints by email to the address $\underline{contact@learnfrenchwithlily.fr}$.
10. Intellectual Property
All elements of the Site are and remain the exclusive intellectual property of LFTwL. Any reproduction, representation, or use, even partial, is subject to the express and prior authorisation of LFTwL.
11. Protection of Personal Data
By ordering, the User consents to LFTwL‘s use of personal data concerning them for order processing only. Information is confidential and will not be disclosed to third parties.
In accordance with the French “Informatique et Libertés” law, the User benefits from a right of access, rectification, and deletion of their data by contacting LFTwL at $\underline{contact@learnfrenchwithlily.fr}$.
12. Severability of Clauses
If any clause is declared inapplicable or invalid, this will not affect the validity of the other provisions, and the invalid clause will be replaced by the closest possible provision.
13. Force Majeure

Neither LFTwL nor the User shall be held liable for any failure, non-performance, or delay in the performance of any of their obligations described in these GTC resulting from a case of force majeure. In this regard, force majeure is defined as any external, unforeseeable, and irresistible event within the meaning of Article 1218 of the French Civil Code. By express agreement, the following are considered cases of force majeure or fortuitous events, in addition to those usually recognized by the jurisprudence of French courts and tribunals: total or partial strikes, lockouts, riots, civil unrest, insurrections, wars, severe weather, epidemics, disruption of transport or supply chains for any reason, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to marketing methods, computer failures, telecommunication disruptions (including network failures), any challenge to the mathematical foundations governing cryptographic algorithms used for public key infrastructures, and any other case beyond the control of the Parties preventing the normal execution of the contract.
14. Dispute Resolution – Mediation
The User may have recourse to conventional mediation in case of dispute. All unresolved disputes will be submitted to the competent courts under ordinary law conditions. These GTC are governed by French law.
15. Language
These GTC are drawn up in the French language. In the event of translation, only the French text shall be deemed authentic in the event of a dispute.
