General Terms & Conditions

1. Purpose and Application

These General Terms and Conditions of Sale (hereinafter “G.T.C.”) define the erms and conditions under which any person (hereinafter “the User”) orders and purchases services sold by the company Leam French and Travel With Lily- Lynda Ait Djoudi
Oufella (hereinafter “LFTwL”), within the framework of a remote sales system via the Internet and mobile, for language training services defined in the store on the websites and mobile site learnfrenchwithlily.fr (hereinafter “The Site”).

These G.T.C. are made available to the Client to allow them to book a service. By completing a service reservation request on the Site and confirming their reservation, the User fully and unconditionally accepts these G.T.C., which will solely govem the
ensuing contract.

LFTwL reserves the right to modify all or part of these G.T.C. at any time.

 

2. Products

The services offered to the User are those listed in the store published on the Site, subject to the availability of the trainer.

 

3. Reservation

3.1 Free Service

To book a free service, the User must select the service and then choose a time slot from those available. They must then register and agree to provide the following information with honesty and accuracy:

  • Last Name;
  • First Name;
  • Email Adress;
  • Phone Number;
  • Password.

Once this information is entered, the User must confirm and will be presented with a summary of their reservation which can be modified or confirmed again. Once confirmed, the User can see the confirmation of their reservation on the Site and will also receive a confirmation email containing a video conference link (Zoom) with their connection code, a calendar invitation, and a link to a form to specify their needs (goals, French level, and topics to be covered).

The free service can only be used once per User. Any attempt to circumvent this rule, including the use of fake accounts to multiply free slot reservations, may lead LFTwL to deny access to the User.

3.2 Paid Services

To book other (paid) services, the User must select the chosen service by clicking on the “book” button and then on the “prepaid”tab, which grants access to various “solo” and “duo” services. The User can then reconfirm their choice and register. To do so, they agree to provide the following information with honesty and accuracy:

  • Last Name;
  • First Name;
  • Email Address;
  • Phone Number;
  • Password.

The User will then be directed to the secure payment page of the partner payment provider (Stripe), where their payment details are required to complete the purchase. The User agrees to provide this information in good faith to finalize the service reservation. They will receive a payment confirmation on the Site and by email at the address provided during registration.

Once payment is made, the User must choose their time slots from those available during the booking period. If they do not wish to book ail available slots for the open booking period, they may defer the reservation of some slots to the opening of a new booking period. In this case, they will be granted credits equivalent to the unreserved slots. Packages are valid for 6 months; after this period, unused credits will be forfeited.

Once the slots are confirmed (either as a reservation or credits), the User can see the confirmation of their reservation on the Site and will also receive a confirmation email containing a video conference link (Zoom) with their connection code, a calendar invitation, and a link to a form to specify their needs (goals, French level, and topics to be covered).

Solo service mini-group sessions accommodate a maximum of 3 to 5 participants. To ensure a group dynamic conducive to learning, a minimum of 3 people is required. If this condition is not met, the class will be canceled and participants will be informed of the possibility of a refund or postponement

3.3 Duo Services

LFTwL offers certain services that can be conducted in duo. In this case, the procedure is the same as for an individual.

However, the sole User will be considered the contact person for LFTwL throughout the reservation: the User agrees to pay the entire reservation amount and will be the only one to receive the reservation confirmation by email. It is the User’s responsibility to communicate the confirmation email and connection details to their partner so that the partner can access and participate in the reserved service. LFTwL cannot be held responsible for any difficulties accessing the reservation due to the User’s failure to provide the necessary information to their partner.

3.4 General Provisions

By clicking on the Site’ s icon to validate their reservation, the User acknowledges having the full legal capacity to commit. Before paying for the reservation, the User declares having read and accepted these G.T.C. Therefore, validating the reservation constitutes unconditional acceptance of these G.T.C.

For a 1- hour package,the User may cancel their reservation up to 48 hours before the scheduled date directly from their personal space. In this case, the User’ s account will be credited, and they can choose a new time slot, also from their personal space, or request a refund by contacting LFTwL directly at contact@learnfrenchwithlily.fr.

For a 10-hour package, the user may cancel their reservation up to 48 hours before the scheduled date, directly from their personal account. In this case, the User’s account will be credited, and they can select a new time slot, also from their personal account. Any package that has been started cannot be refunded, even partially.

Beyond the 48-hour period before the reservation, the User wishing to cancel must notify LFTwL by email at contact@learnfrenchwithlily.fr. They will not be entitled to any refund or replacement of the reservation.

Any delay of more than 15 minutes from the reserved time slot will result in the cancellation of the service without any right to a refund.

LFTwL reserves the right to refuse a reservation in case of the Client’s failure to meet any of their obligations and more generally, to refuse any reservation deemed abnormal or incomplete for any reason. The order is only final after confirmation by email from LFTwL.

 

4. Prices

The prices listed are in Euros, including all taxes.

The included V AT is the French V AT applicable on the day of the order. If the VAT rate changes, these changes may be reflected in the price of services without prior notice to the User. However, prices cannot be modified once the reservation is confirmed.

 

5. Payment Methods

Payment for services is made by credit card, VISA, MASTERCARD online via through the secure payment system provided by Stripe. Card payment validation is immediate.

To be registered, the reservation must be paid in full. Unpaid reservations cannot be processed.

 

6. Right of Withdrawal

In accordance with current legislation, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period and whose performance has started with the User’ s consent or at their express request. A service may be considered as performed if the User has made a reservation but has not utilized the service without cancellation. Therefore, the User cannot invoke this right. For
example, if the User books a service less than 14 days before its execution, they cannot use the right of withdrawal to cancel or request a refund for the reserved service.

For other reservations, the User has a period of fourteen (14) days from the reservation to exercise their right of withdrawal with LFTwL, without having to justify reasons or pay penalties, for exchange (subject to availability) or refund. If this period expires on a Saturday, Sunday, or public holiday, it is extended to the next business day. The right of withdrawal can be exercised on plain paper. If submitted online, via contact@learnfrenchwithlily.fr, an acknowledgment of receipt will be immediately provided to the User by all means.

 

7. Availability of Services

Les services vendus sur le Site sont proposés dans la limite de la disponibilité de la formatrice.

LFTwL reserves the right, at any time and without justification:

  • To cancel, suspend, or reschedule a reservation;
  • To interrupt the execution of a service in case of misconduct by a User.

In the first case, the User will be offered a new time slot by any means, which they can accept or request modification if not available.

Cancellation of a reservation or interruption of a service by LFTwL does not entitle the User to a refund.

 

8. Service Execution and Liability

The User will receive a reminder email one day before the reserved slot at the address provided during registration, reminding them of their reservation and the connection details for the video conference (Zoom).

On the day of the service execution, it is the User’ s responsibility to ensure they have a sufficient internet connection and appropriate computer equipment for the service to take place. LFTwL disclaims any responsibility for technical difficulties or connection issues that may complicate or prevent the execution of the service. Such issues do not entitle the User to a refund.

LFTwL guarantees the proper execution of the services described in these general terms under the conditions outlined. As such, LFTwL is only bound by an obligation of means regarding the services provided.

In any case, LFTwL’s liability is limited to direct and material damages resulting from the execution of the services, up to the total price of the services performed by the User in the last calendar year.

 

9. Complaints

The User may submit complaints by email to contact@learnfrenchwithlily.fr.

 

10. Intellectual Property

All elements of the Site (photographs, illustrations, pictograms, descriptions, logos, trademarks) are and remain the intellectual and exclusive property of LFTwL.

Reproduction, representation, exploitation, redistribution, or use of any kind, even partially, of elements of the Site, whether software, visual, or auditory, is subject to the express and prior authorization of LFTwL, holder of ail intellectual property rights.

 

11. Protection of Personal Data

By ordering through the Site, the User consents to LFTwL’s use of their personal data.

LFTwL is committed to not disclosing the information provided by the User on the Site to third parties. This information is confidential and will only be used for processing the order.

In accordance with Articles 39 and 40 of the French Data Protection Act of January 6, 1978, the User has the right to access, rectify, and delete their data. To exercise this right and obtain information, the User can contact LFTwL at contact@learnfrenchwithlily.fr.

 

12. lndependence of Clauses

If any provision of these General Terms and Conditions is declared inapplicable or invalidated for any reason, such invalidity shall not affect the application or validity of the remaining provisions. The invalid or inapplicable provision will be replaced by the closest possible provision.

 

13. Force Majeure

Neither LFfwL nor the User shall be held responsible for any non-performance, failure to perform, or delay in performing any of their obligations described in these G.T.C. resulting from a case of force majeure.

Force majeure is defined as any extemal, unforeseeable, and irresistible event according to Article 1148 of the French Civil Code. Specifically, force majeure or fortuitous events include, but are not limited to, total or partial strikes, employer strikes, riots, civil disturbances, insurrections, wars, severe weather, epidemics, blockades of transportation or supply for any reason, earthquakes, fires, storms, floods, water damage, government or legal restrictions, legal or regulatory changes in marketing practices, computer failures, telecommunications blockages including communication networks, any challenge to the mathematical foundations goveming cryptographie algorithms used for public key infrastructures, and any other case beyond the Parties’ control preventing the normal execution of the contract.

 

14. Dispute Resolution – Mediation

The User may resort to conventional mediation, notably through the Consumer Mediation Commission or other existing sectoral mediation bodies, or any alternative dispute resolution method (such as conciliation) in case of dispute.

Ail disputes arising from the services subscribed to under these General Terms and Conditions, conceming their validity, interpretation, execution, termination, consequences, and aftermaths, which have not been resolved amicably between the User and LFTwL, shall be submitted to the competent courts under common law conditions. These General Terms and Conditions are govemed by French law.

 

15. Language

These General Terms and Conditions are drafted in French. In case of translation into one or more foreign languages, only the French text shall be authoritative in the event of a dispute.
